3일 방송통신위원회와 한국인터넷진흥원(KISA)은 최근 청소년들을 현혹해 불법 도박 스팸 문자 메시지를 전송하도록 하는 아르바이트가 확산하고 있다며 주의를 당부했다.

이들은 ‘문자 알바’ 또는 ‘핸드폰만 있으면 어디서든 가능한 초간단 알바’ 등으로 청소년을 유혹하고 있다. 광고를 본 청소년들에게 모바일 메신저(카카오톡) 아이디로 친구 등록하도록 한 후 광고 문자 문구와 전송 방법방이동노래방알바을 알려주고, 다량의 휴대전화 번호를 전달해 1일 약 490여건의 불법 도박 스팸 문자 전송을 지시하는 식이다. 이는 이동통신사들이 스팸 방지 대책의 일환으로 개인이 하루에 보낼 수 있는 문자 건수를 500개로 제한했기 때문이다.

방통위는 이같은 문자 알바는 정보통신망법 위반으로 형사처벌까지 가능한 범죄라고 경고했다. 정보통신망법에서는 법률에서 금지하는 재화 또는 서비스에 대한 광고성 정보를 전송한 자는 1년 이하 징역 또는 1천만 원 이하 벌금에 처하도록 하고 있다.

당근알바 백병한 팀장은 “당근알바는 개정된 직업안정법 시행령에 선제적으로 움직이며 사장님들에게 필요한 정보와 절차를 신속하게 제공하고, 구직자 보호에 앞장서고자 이번 프로모션을 진행하게 됐다”라며, “앞으로도 당근알바는 동네 일자리 연결에 최적화된 서비스 개발과 기술 고도화를 통해 구인구직 시장의 새로운 패러다임을 제시할 것”이라고 전했다.

해당 광고를 본 청소년들에게 모바일 메신저 아이디(ID)로 친구 등록을 하도록 해 광고 문구와 전송 방법을 알려주고, 하루에 약 490건의 불법 도박 스팸 문자 전송을 지시하는 식이다. 이동통신사는 스팸 방지 대책으로 개인이 하루에 보낼 수 있는 문자 건수를 500개로 제한하고 있다.

정보통신망법에 따르면 이 같은 전송 행위는 형사처벌(1년 이하의 징역 또는 1000만 원 이하의 벌금)까지 가능하다. 불법 스팸을 전송한 청소년의 휴대전화 번호는 이용 정지될 수도 있다.

임금이 체불된 20대 PC방 아르바이트 노동자에게 고용노동청 근로감독관이 ‘2차 가해’를 한 정황이 드러나 파장이 일고 있다. 가해자 분리 조치 없이 대질조사가 이뤄졌고, 그 과정에서 피해자는 사업주 막말에 노출됐다. 피해자측은 근로감독관이 5명 미만 사업장에 미적용되는 사항을 사업주에게 직접 설명하는 등 편향적 태도로 일관했다고 주장했다.

월급 요구에 사장 욕설 “싸가지 없는 X”

5일 <매일노동뉴스> 취재를 종합하면 대학생 이하온(20·가명)씨는 광주시의 한 PC방에서 두 달간 일했지만 급여를 받지 못해 지난해 12월 광주지방고용노동청에 진정을 제기했다. 이씨는 두 달치 월급 약 190만원이 체불됐다고 주장하고 있다.

이씨는 지난해 9월17일 최저임금인 9천160원에 1년간 근로계약을 체결했다. 주말 야간(오후 11시~다음날 오전 9시)에 일하며 카운터 업무를 도맡았다. PC방 사장 A씨는 3개월간 수습기간에는 월급의 90%만 지급하겠다고 했다. 근로계약서상 휴게시간은 50분 근무에 10분이었다. 하지만 제대로 지켜지지 않았다고 한다.

그런데 급여일인 10월5일이 지났는데도 월급이 들어오지 않았다. 이씨는 엿새가 지난 뒤 A씨에게 연락했다. 하지만 A씨는 “싸가지 없는 X이” “이 XX가” 같은 욕설을 퍼부었다고 한다. 임금 미지급 사유 문의에도 “그걸 왜 나한테 물어보나. 다른 직원들이 월급 받았는지 걔들과 얘기하라”며 윽박질렀다고 이씨는 전했다. 하루 뒤 이씨의 통장에 월급의 일부인 55만원만 들어왔다. 홀로 자취하던 이씨는 월세를 내야 하는 상황이었다.

상황은 다음달에도 같았다. A씨가 월급을 주지 않자 이씨가 재차 임금 지급을 요구했지만 거부됐다. 결국 이씨는 급여일 다음날 퇴사했다. 이후 사회관계망서비스(SNS)를 통해 계좌에 입금해 달라고 요청했으나 A씨는 “입금은 없다. (직접) 와야 준다”며 거절했다. 지급일 연장에 대한 합의는 없었다.

대질조사서 피해자 대면한 사업주 폭언

이씨는 노동청에 달려갔다. 하지만 근로감독관 B씨의 태도가 석연치 않았다고 한다. 이씨측은 대질조사에 앞서 A씨가 위협할까 걱정돼 개별조사 요구와 분리조사 같은 신변보호 조치를 요구했다. 그러나 B씨는 이씨 요구를 묵살했다. 결국 이씨는 지난달 3일 진행된 대질조사에서 A씨와 마주해야 했다. 이씨는 아버지, 박영민 공인노무사(노동인권 실현을 위한 노무사모임)와 함께 참석했다. PC방 사장 A씨는 아내와 같이 출석해 나란히 앉았다.

우려했던 상황이 벌어졌다. 이씨측이 상시근로자가 5명이라는 취지로 주장하자 A씨는 “지금 뭐 하는 것이냐”며 “거지XX도 아니고”라고 폭언을 쏟아냈다. 박영민 노무사는 “이런 사태를 걱정한 것”이라며 즉각 제지했다. A씨 부부는 아버지가 있는 앞에서 이씨가 흡연한다는 식의 발언도 꺼냈다.

A씨 아내는 “(알바가) 흡연하면서 휴대전화를 갖고 나가면 기본 10분은 쉬었다가 들어온다”고 했다. 근로계약상 휴게시간을 50분 근무에 10분이라고 적은 부분이 지켜졌으므로 휴게수당을 줄 의무가 없다는 취지의 발언 중 나온 얘기다. 이씨는 당시 상황에 대해 “진정서 제출할 때 분명히 보호조치를 해달라고 했는데 아무런 조치도 없어 A씨가 너무 쉽게 공격했다”며 “부모님이 계신데도 이렇게 말해 굉장히 당황했다”고 토로했다. B씨는 A씨측의 막말에 아무런 대응을 하지 않았다고 이씨는 전했다.



감독관, 상시근로자 5명 미만 ‘상세 설명’

핵심 쟁점인 ‘5명 미만 사업장’과 관련해서도 이씨측은 근로감독관이 편향적인 태도를 보였다고 주장한다. 상시근로자가 5명 미만일 경우 근로기준법상 연장·야간·휴일근로가 적용되지 않는다. A씨는 직원 숫자와 관련해 최초 “(주야간 세 타임에) 시간당 2명씩 근무한다”는 취지로 말했다. 하지만 B씨가 “이렇게 계산하면 가용인원이 6명이 되므로 상시근로자가 5명 이상”이라고 말하자 “교대타임에 1명씩 근무한다”고 말을 바꿨다. 게다가 B씨가 5명 미만 사업장 기준을 종이로 출력해 A씨에게 보여주며 자세히 설명했다고 한다. 이후 A씨측은 상시근로자가 5명 미만이라 야간근로수당 지급의무가 없다고 주장했다.

이씨측의 ‘현장조사’ 요구도 막혔다. 이씨측은 주야간 메인·서브 근무자와 매장을 청소하는 직원 등 총 7명이 상시근로자에 해당한다고 주장했다. 이에 대질조사 이후 A씨 발언의 진위 여부를 확인해야 한다며 B씨에게 현장조사를 요청했다. 그러나 B씨는 현장조사 실시 여부는 본인 권한이라며 거부했다.

A씨는 진정 두 달여 만인 최근 급여 약 110만원을 지급한 것으로 확인됐다. 야간근로수당과 휴게수당은 제외됐다. 이씨측은 B씨가 확정한 금액과 입금액이 똑같다고 전했다. 박영민 노무사는 “B씨가 알려준 대로 급여를 지급한 것이라고 보인다”고 의심했다. 이씨는 “A씨가 입금 전후로 아무런 연락도 하지 않았다”고 했다.

근로감독관 “편향조사 아냐, 감독관 권한”

반면 근로감독관 B씨는 ‘편향 조사’는 이뤄질 수 없다고 선을 그었다. 그는 지난 3일 <매일노동뉴스>와 통화에서 “A씨가 제출한 직원근무표 등 자료를 근거로 체불액을 확정했다”고 했다. 대질조사 분리조치가 이뤄지지 않은 부분에 대해선 “이씨는 대학생이고 성인인 데다 사실관계가 다 파악되지 않아 분리해 조사할 필요가 없었다”며 “갑작스러운 욕설을 선제적으로 막을 수 없지 않나. 이씨 아버지도 동석해 문제없다고 봤다”고 답했다.

‘5명 미만 사업장과 관련한 설명을 왜 했냐’는 질문에는 “A씨가 평일근무를 잘 모르는 듯해 교정해 준 것일 뿐 컨설팅 차원이 아니다”고 일축했다. 나중에 직원근무표 일체를 확인했으므로 대질조사 당시 A씨 진술 자체도 의미 없다는 의미다. ‘현장조사 요구 거부’ 역시 “근로감독관 권한”이라며 “전체 근무표를 받았는데 현장에 가서 상주하며 확인할 필요가 있느냐”고 반문했다. 광주지방노동청 관계자는 “대질조사에서 이견이 생기면 흥분해 돌발 상황이 발생하기도 한다”며 “혹여 2차 가해가 되지 않도록 담당 근로감독관에게 확인해 보겠다”고 답변했다.


피해 대학생 “적어도 중립적으로 조사해야”

이씨측은 ‘을의 위치’에 놓인 청년아르바이트 노동자에 대한 보호가 없었다고 비판했다. 박영민 노무사는 “적반하장 태도로 나오는 가해자에게 근로감독관이 강력한 조치를 하기는커녕 방관하고 오히려 피해자를 탓해 피해자가 또 다른 상처를 입었다”며 “임금체불은 심각한 범죄인데도 사업주에게 지나치게 관대하다”고 지적했다. 고용노동부의 ‘계층별 맞춤형 예방감독’ 실시 계획도 이 같은 상황에서는 실현되기 어렵다고 목소리를 높였다.

이씨는 A씨가 형사처벌을 받아야 한다고 했다. 그는 “하루에 10시간씩 피곤한데도 일했다. 그런데 사장은 임금체불 이후 단 한마디 사과도 없이 당당했다”며 “일언반구도 없이 돈을 입금한 것도 그렇고, 자신이 갑의 위치라고 생각하며 잘못을 인정하지 않으려 한다”고 말했다.

그는 근로감독관 태도를 강하게 비판했다. 이씨는 “근로감독관이 대놓고 사장에게 힘을 실어줘서 많이 실망스러웠다”며 “이런 반응이 나오면 또 임금체불을 당하게 되더라도 선뜻 신고하기 어려울 것 같다”고 토로했다. 무엇보다 “청년노동자가 또 이런 피해를 입지 않길 바란다”며 이런 말을 남겼다.

“청소년들은 노동청 문턱을 넘기 쉽지 않습니다. 그런데 노동청이 고용주쪽에 편향된 것을 보고 신뢰를 많이 할 수 없게 됐어요. 근로자의 편이 돼 달라는 것은 아닙니다. 적어도 중립적으로 조사했으면 해요.”



최근 보이스피싱 범죄조직이 ‘고액 알바’를 가장한 구인광고로 모집한 청년들을 현금 수거책으로 이용하는 사례가 늘고 있다.

6일 대전지검 천안지청에 따르면 천안·아산지역에서 보이스피싱 범죄로 형사재판을 받게된 20대는 2020년 42명, 2021년 63명, 2022년 115명으로 급증하고 있다.

이는 3년 전과 비교해 173% 증가한 것이다.

대부분 집행유예 이상의 무거운 형을 선고 받은 것으로 나타났다.

대전지검 천안지청은 지난해 연말부터 지역 대학생들을 상대로 보이스피싱 범죄 연루 예방을 위한 대학생 간담회와 강연을 개최했다.

천안·아산지역에는 모두 16개 대학이 있고 12만 여 명의 대학생이 재학 중이다.

정유미 대전지검 천안지청장은 “지역 대학교와 긴밀히 소통해 보이스피싱 범죄 예방을 위해 최선을 다할 예정”이라고 말했다.

A씨는 중고거래 플랫폼 당근마켓에서 하루 10~20만원의 수익을 약속한다는 상품권 구매대행 알바를 보고 사업주에게 근무조건 등을 문의했다. 선뜻 망설이는 A씨의 계좌에 이윽고 500만원이 입금됐다. A씨는 이 중 5%를 알바비로 수령하고, 나머지 금액으로 편의점을 돌며 상품권을 구매했다.

이후 상품권 핀 번호를 찍어 사업주에게 보냈다. 얼마 후 A씨의 계좌는 정지됐다. 알고보니 애초 받은 500만원은 보이스피싱 범죄 수익이었고, A씨는 보이스피싱 수익을 상품권으로 세탁하는 일에 조력한 꼴이 돼 처벌받게 될 상황에 놓였다.
